Terms of Service

1. Acceptance of Terms

By accessing or using the AJO platform ("Service"), including our website at ajo.co, mobile applications, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

AJO reserves the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

2. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You must be at least 18 years of age to create an account and use our genetic testing services. For journaling and family tree features, users under 18 may use the Service with parental or guardian consent.

3. Subscription Services

AJO offers various subscription tiers and one-time purchases for genetic testing kits and related services. Pricing, features, and availability are subject to change. All purchases are processed through secure third-party payment processors.

Refunds for genetic testing kits may be available prior to sample submission. Once a sample has been submitted to our laboratory partner for processing, the purchase is non-refundable. Subscription fees are billed on a recurring basis and may be cancelled at any time, with cancellation taking effect at the end of the current billing period.

4. Genetic Testing & Data

AJO's genetic testing services are provided for informational purposes only and are not intended to diagnose, treat, cure, or prevent any disease. Genetic test results should not be used as a substitute for professional medical advice, diagnosis, or treatment.

All genetic testing is performed by CLIA-certified and CAP-accredited laboratory partners. By submitting a sample, you consent to the processing and analysis of your genetic material in accordance with our Privacy Policy. You retain ownership of your genetic data and may request its deletion at any time.

AJO does not sell your genetic data to third parties, including employers, insurance companies, or advertisers. Any participation in anonymized research programs is strictly voluntary and requires separate, explicit consent.

5. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal and genetic information. By using the Service, you consent to the practices described in the Privacy Policy.

6. User Content

The Service allows you to create, upload, and share content including family tree data, voice recordings, journal entries, photographs, and other materials ("User Content"). You retain all ownership rights in your User Content.

By submitting User Content to the Service, you grant AJO a limited, non-exclusive, worldwide license to store, process, and display your content solely for the purpose of providing and improving the Service. This license terminates when you delete your content or close your account.

You are solely responsible for your User Content and represent that you have all necessary rights to submit it. You agree not to submit content that is unlawful, defamatory, or infringes on any third party's rights.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by AJO and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The AJO name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of AJO.

8. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AJO does not warrant that the Service will be uninterrupted, timely, secure, or error-free. Genetic test results are subject to the inherent limitations of current scientific knowledge and testing technology. Results may be updated as science advances.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AJO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

AJO's total liability for any claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to AJO during the twelve (12) months preceding the claim.

10. Termination

You may terminate your account at any time by contacting us at hello@ajo.co or through your account settings. AJO may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms, without prior notice or liability.

Upon termination, your right to use the Service will immediately cease. You may request a copy of your data, including genetic data, prior to account deletion. AJO will retain and delete your data in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Fairfield County, Connecticut.
